So my apartment lease is coming up for renewal. It's been no problem the last two times, but this time they seem to have changed management and it's really giving me issues. The renewal document they sent me honestly seems to be missing several paragraphs or even several pages. Some paragraphs don't follow logically from the previous paragraphs. Also, the whole thing looks very shady, and calling up to the front office to try and get them to explain it just gets me even more confused. Usually the manager I'm talking to is clearly extremely annoyed that I'm bothering her and actually reading the contract instead of just signing it. The last conversation went something like this: "I'm telling you, this contract doesn't say whether it's a year lease or a month-to-month agreement. Maybe you forgot to send me a page?" "No, that's explained in the third and fourth paragraphs on the third page." "No, it's not, it explains what the rate is for a year lease and for a month-to-month agreement, but it doesn't say which of those two I actually am." "Well, it's a year lease, just like your last two." "Yes, but it doesn't say that. The last two did." "We have you on file as it being a year lease. You're fine." "Yes, but I don't have it on file, I would really feel better if you could put a line in here about that." "We don't have authority to modify the contract, they come down from corporate." "Well, how am I supposed to know you won't be charging me the higher rate a month from now? Also it makes a lot of seperate references to "$520" and "current market rent," but it doesn't actually say anywhere that these are the same thing." "The market rent depends on market conditions, it changes often, and this is the standard contract so it's written so we can just modify those numbers on the fly without having to print whole new ones." "Yes, but it says I have to pay the current market rent every month, if that changes couldn't you just arbitrarily charge me more rent next month? The way I'm reading it, you could." "No, we aren't allowed to do that." "Not to accuse you of anything, but I'm a little hesitant to just take your word for it." "Look, would we try to get you to accept this contract if we weren't allowed to let you accept this contract?" ".....what?" "Look, I have a meeting in a few minutes, can I call you back about this later?" ".....ok" That was two days ago. No call back. I'm a week from when I'm legally required to either sign something or give them notice that I'm leaving, so it's really got me worried. |

How much do you like the apartment. How much do you hate moving. If its a lease they shouldn't be allowed to raise your monthly rate beyond the inevitable annual bump. If its a month to month, they can, but then you can give them notice and move. Personally, I'd start packing if they aren't willing to put things down in plain English. |

Just don't sign. Usually that extends your previous lease for a year, and I'd bet there is verbage in the contract that states just that. |
