Hansen Beverage trademarked “Monster Energy” under the categories “Non-alcoholic beverages, namely, energy drinks, excluding perishable beverage products that contain fruit juice or soy.” and “Nutritional Supplements,” in 2007. Rock Art Brewery trademarked “Vermonster” under the “beer” category in 2009. The owner of Rock Art Brewery offered to stay out of the energy drink market, willing to give up his trademarked name in that category. “Their lawyer stated that they are not concerned with energy drinks, that Monster wants to now get into beer.”
And the sad part is, the owner of Rock Art Brewery has talked to 6 different trademark lawyers, all of which tell him he is in the right, and has done nothing wrong. However, he will eventually lose because a huge corporation like Hansen Beverage will just keep the issue in the courts until the smaller company goes bankrupt and they win by default.
