I still maintain it's a weird choice, especially for network TV.

And I have no idea how Fox doesn't have the rights. Is the notion that even though they're mutants, they basically never run with the X-Men, so Marvel retained them so long as they don't call 'em mutants?

They didn't call them mutants right away if I remember right. That came later on down the road.

As I understand it, the motion picture rights and the television rights are separate. That doesn't mean there can't be some conflicts when it comes to live action. Disney waited until motion picture rights reverted back in 2013 to even start considering anything live action with Daredevil, for instance, to stay safe. They got back Punisher, Ghost Rider, and Blade at roughly the same time. What Fox owns is X-Men and Fantastic Four, and all sidekicks and villains. This is also somewhat dependent on strength of affiliation. Scarlet Witch and Quicksilver, you'll notice, were in Age of Ultron. So Fox doesn't own all mutants. You could probably make a successful case that Fox doesn't own any sort of lock on the Marvel concept of mutants. I'm not entirely certain how they're going to do Infinity War without Silver Surfer, although perhaps they'll get him back this year, that trash FF title was from 2007, and the even worse reboot of 2015 didn't involve him, so possibly the fact he has his own line will let him revert.

As I understand it, the rights are about in which comic line the characters made their debut.

Disney has actually directed Marvel comics to stop introducing new characters in the x-men comics. After a character has been introduced elsewhere, they can bring the character to x-men.

Scarlet witch and Quicksilver were actually uniquely negotiated so both fox and Marvel could use them independently.

They go back and forth on whether they were mutants or mutates. I think they're considered to be more the latter now.

I just ordered the TPB for their early appearances. My brother owned the comics when I was younger, so I never had them. :)
