If the sellers of the house my wife and I wound up with tried this, we would have politely declined, and continued to look. In the current economy, the guy should be pleased someone is actually able to buy his property, not screw you over on this sort of thing.

found out the seller is in foreclosure. On the advice of my lawyer, I'm turning down the sale, going to buy it from the bank at reduced price.

According to It's Always Sunny in Philadelphia, people who lose their home to forclosure often smear feces on the walls.

Jesting aside, my wife and I took a look at a couple forclosed homes when we were in the market, and some of them looked like the scene of some urban warfare. Not saying the guy is going to trash the place when they boot his ***, but make sure to take a close look at it before signing.
