Can die in a fire and burn in the festering pit that is Michael Moore's bowels.

I ordered my PC parts from Newegg as I have ever time I've built a machine for as long as Newegg has been in business.

The motherboard and processor were DOA.

They were RMA'd and return shipped via UPS less than 24 hours after I signed for them.

UPS took 15 days to return the RMA'd items.

The box was destroyed in transit.

Newegg voided the RMA because it did not arrive within 14 days.

And Newegg is refusing to consider any further action because of the damage sustained in transit.

Pardon me, but:

1. Did you insure the package?
2. Sounds me like UPS is the one that should be dwelling in Michael Moore's bowls.

Newegg provided return label, Rorinthas ...

Insurance and transit damage are part of their agreement.

A similar experience pushed me from Newegg to Amazon.

I'd say you have a legitimate beef with UPS, at least.

I have no beef with UPS. I did not pay for shipping. Newegg paid for return shipping and specified the carrier.

Regardless, UPS is responsible for the damage and missing service on delivering the package. I am fairly certain that the service expectation from UPS for whatever shipping level was selected by Newegg was not 14+ days.

At very least, UPS owes for the damage it has now caused.

And yeah, Newegg sounds like they're a bunch of @$$holes.

Except I am not UPS's customer in this case and cannot file a claim against them for the damages.

That does indeed suck...

I guess I've been lucky? I've been dealing with newegg for nearly as long as they've existed. I've never had any problems with them, even on the rare occasion I've had to RMA something.

If they provided a label for RMA, I will guarantee they were notified when the package was picked up. That is one of the points of the shipping being invoked by the vendor: they can monitor the RMA process from start to finish.

They can also reason that the package wasn't in a destroyed condition when UPS accepted it because UPS does not accept packages which are destroyed.

Surely a CS rep can check the RMA action history and see it was received by UPS and the 14 day delay was UPS's doing. From there, it stands to reason that UPS also destroyed the package.

There should be a guarantee from the manufacturer, use that. Barring that, use your credit card guarantee.

HOw is blaming Newegg for UPS's shipping problem....as normal that makes no flipping sense, how in any way shape or form is this newegg's fault?

I have never onced been able to request an RMA via Newegg without paying for return shipping this is ups's fault not newegg, how are they responsible for the UPS's shipment???

Kashan:

Newegg voided the RMA and refuses to take further action on the case, which leaves me out money and product. Moreover, since Newegg paid return shipping (phone calls are awesome like that), Newegg has to file a claim against UPS. I cannot.

Of course, it works like this if you really wanna be technical about it ...

UPS is a FOB freight service. Liability for the state of the package and its contents lies with the freight company only until the point someone accepts it at the receiving location. Even were I the person to have shipped the box, by signing for it and accepting, Newegg assumed responsibility for the state of the contents and the package itself.

However, since I did get Newegg to pay the return shipping on the product, they're responsible for it on both sides of the shipping transaction, while UPS only has to worry about the product until the point the Newegg Receiving Department accepts it from the Brown Truck of Should Also Die in a Fire.

UPS was just UPS and did a pour job managing freight: they do this regularly. Newegg, however, based on the actions of UPS a) voided my RMA and b) refuse to address the defective product they sent me in the first place.

What about a call to your credit card company and disputing the charge or filing axwarranty claim?

Charge to my credit card is over 30 days old.

And I can't file a warranty claim with product I won't be getting back.

This is when you turn on your Southern Belle voice and talk to someone on the phone....it works every time.

You wanna make that phone call for me? Cause my "Southern Bell" voice is the sound of me ramming a phone down the CSR's throat with an excavator.

If you were anywhere nearby, I would. It's hard to answer all the questions, tell the story, and give all the information that they would need if you are not right there with me to answer them.
Resist the urge to sound angry and entitled to compensation, make your voice softer and slower and try to sound confused "I've been a loyal customer for years, I love this company, this is the first time I've had a problem and I just don't understand. Can you help me?", be very very very very polite and sweet, use the rep's name, praise the company, express the damage that this failed transaction has done to you, but not in an angry way, in a soft-spoken "I just don't understand" kind of way which will make the rep desire to help you, at each turn thank the rep for their time and what they are doing "I really appreciate this, thank you. Sure, I'll hold, no problem." ....9 times out of 10 I've used this with customer support for various issues and I've wound up with financial or product compensation. Most companies have a loss-control department or something where they are willing to shell out a few dollars to retain customers.

Hmmmm.....according to their website, the customer is responsible for return shipping:

http://www.newegg.com/HelpInfo/FAQDetail.aspx?Module=4

Quote:
Does Newegg pay the return shipping cost for defective merchandise? No, Newegg does not pay the return shipping cost for defective merchandise. We are not responsible for product defects, because we do not manufacture the products we carry. However, if you pay to send the item back to Newegg, we will replace the item and ship the replacement to you at no charge. Newegg will employ every resource it has to ensure that your item is replaced promptly, without hassle.

Khross, wouldn't that mean that you should be calling UPS for compensation?

LadyKate:

Yes, but I called them and got them to pay return shipping, LadyKate. If I had paid shipping, it would be a different matter entirely (at least as far as UPS is concerned).
