Except when they use speed cameras. We had a big debacle with them here at one time, and fortunately they ended up gone.

The camera is a form of observation of the actual violation. I'm not privy to all the nuances of the dispute in your area.

Some states (like CA/AZ) with cameras also require that tickets be served in person, so you can pretty much ignore anything that comes in the mail. If you can avoid being served in person for 120 days (may vary based on state) then it's case-closed.

Basically it had to do with the realization that a lion's share of the fees were going to go to this out of state provider, who later ended up going bankrupt, which has little to do with the OP admittedly.

They observed him at one point and again at another point which could not be reached going the posted speed limit. (Hypothetically of course for now) Could that be used? I remember that being a concern for EZ passes when they first came out.

Technically speaking, any type of speed determination requires observation at 2 points and the time passed during travel between them. With devices like radar and lasers they do this by means of doppler shift and the time between points is infinetismal compared to visual observation means, but its still happening. From a scientific standpoint, there's nothing wrong with the "2 camera observations, you were speeding" method. It's simple mathematics.

From a legal standpoint though, observation is generally required at the actual point at which the speeding occurred, so unless it happened where one camera or the other could see it, it probably wouldn't work.

I've wondered previously why they don't do this on the Florida Turnpike. Your SunPass entered tollbooth X at 5pm, exited tollbooth Y at 7pm, these points are 180 miles apart. You were going 90mph, we'll tack it on your SunPass tab which already automatically deducts from your credit/debit card. (If you don't have a SunPass, then just use the license plate photos they already take at the booths, and generate the citation by mail. If you don't have a recognizable license plate, determine this through some algorithm and dispatch a FHP trooper to meet you before the next exit.)

Seems like a great way to generate revenue while penalizing speeders. I mean, someone could speed and then stop at a rest stop for a while, but still, you wouldn't be getting any false positives, just false negatives.
