It was determined to move to 367 Evening Side and attempt to contact Mitchell. If Mitchell answered the door he would be asked to leave. If he refused to leave he would be arrested for Obstructing a Police Officer.

First of all, yes this is shitty and should be illegal. I'd like to see all officers involved reprimanded or fired because of it. But...

Does the third amendment even apply since the police officers aren't soldiers? I don't know.

The author wasn't sure either Lenas.

That sure sounds crazy messed up.

Assuming the facts are reasonably accurate, then no, the Third amendment doesn't even remotely apply. Police officers are not soldiers. It's irrelevant though; none of what they did was excusable anyhow.

We are, however, talking about a website that represents the IRS scandal as Obama trying to ban protests, by flying C-17s over them and dropping bombs on them.. because, you know, that's what happens when the tax laws are abused; bombing raids on protests from aircraft that aren't bombers in the first place. Therefore, the facts of the case may not be exactly as represented.

This is why we don't get our news from blogs and agenda websites.

I will look for other sources then, I did not even know about the issue until a co worker brought it up.

Snarky source (with links to others) but supports the basic facts.

I find the entire Third Amendment thing rather silly; there's more than enough evidence (and a far stronger case) for a violation of the Fourth Amendment, and accompanying civil liberties clauses.

I too would say the house was seized rather than having troops quartered in it.

That doesn't make it any less illegal or despicable.

I'd sue under the third amendment, as well as the other violations. Third amendment would be last on the list, so might not fit on the page, with all the other crazy, crazy nonsense to report.

when I first heard about the story... I immediately thought of Eminent Domain.
