Interesting. President Truman signed a bill establishing an official National Day of Prayer in 1952, but U.S. District Judge Barbara Crabb in Wisconsin ruled April 15 that the law violates the ban on government-backed religion. The Justice Department is appealing the case on behalf of the White House. An injunction against the National Day of Prayer will not take effect until all government appeals have been exhausted. Quote: In ruling that the National Day of Prayer is unconstitutional, Crabb wrote its "sole purpose is to encourage all citizens to engage in prayer, an inherently religious exercise that serves no secular function. ... In this instance, the government has taken sides on a matter that must be left to individual conscience." I don't have much faith that it will stick, but perhaps there's hope afterall. |

Actually, I agree with the President on this one. The National Day of Prayer doesn't violate the Establishment Clause.

Are you penalized for not participating? Told to whom to pray, or what words to pray with? It's not a state religion, then. |

Since the judge is making up bullshit, and the purpose is to encourage those who wish to, to engage in prayer, yes, maybe there's hope he'll be overturned. |

Again, Freedom of Religion is not Freedom from Religion, as the second is an abridgement of the first. Noting that, there becomes an obvious reason that "of" was the word chosen to use instead of "from". |

If the judge had struck it down (which she did) but also said that the gatherings could not go forward (she said they could go forward until after all the appeals), would you have supported Obama for moving forward? I would not, I don't think. Even though I agree it's a bad ruling, checks and balances > all. |

The President can proclaim all kinds of non-mandatory National Days of Whatever any time he pleases, such as when someone important dies. The law has no actual power to compel anyone to do anything, and neither would a Presidential proclaimation. Overturning a law is really supposed to be a check and balance on Congress (who make the laws), not the PResident, who really just enforces whatever the law happens to be. I'd go so far as to say that in this case, since the law has no actual power, it can't be enforced, and therefore overturning it is an attempt by the court to exert power it does not actually have - i.e. to forbid completely voluntary action for no other reason than a non-enforceable proclaimation in favor of it has been issued. |

As long as they don't start penalizing those individuals who do not wish to participate, I see no problem with it personally. Way I see it is -- prayers gonna pray, haters gonna hate, Agnostics gonna remain ambivalent. /shrug |

Planting trees on Arbor Day is voluntary. Flying the flag on Flag Day is voluntary. Remembering the fallen from our many wars on Memorial Day is voluntary. Giving thanks on Thanksgiving is voluntary, and in a lighter mood, Shopping on Black Friday is voluntary. Praying on National Prayer Day is voluntary. And I'll agree with the President on this as well. Very well worded statement that didn't give the nod to any one religion. |
