What exactly are you trying to prove by using my image as your avatar? Are you trying to get some sort of rise out of me? I would certainly appreciate it if you stopped, as I didn't give you permission to do so. However, the image is from the cover of one of my CDs, so it's public domain. But your choice to do so is pretty rude. You mind cutting it out? Thanks. Hell, I'll take the free advertising, if you like.

Is that silly picture of you? I had no idea! I just found some random picture of a seemingly no talent gooberish looking dude and decided to make it my avatar. What is that thing coming out of the side of your head anyway? Insert quarter and get the latest Obama admin talking point?

If anyone is interested, you can go to this website and take a look at my stuff. About Damn Time is not in print at the moment, but you can download Quarters (the album with the image above) from Itunes. It's a lot of SCA specific music, but it's mine. You might find something you like.

Now you all have my image, my last name, etc.

By the way, Nitefox, I'm not sure that image *is* considered public domain. It belongs both to me and the person who created it, and I'm pretty sure that if I request that you stop using my image, you're supposed to comply. Someone with more legal knowledge might have a better take on that.

Until then, consider this an official cease and desist request. You do not have my permission to use that image.

What is SCA specific music? I have a mental image of 60's style "Camelot" movie interpretations with men in green tights jumping around strumming lutes, etc.

No, just some songs about things specific to the SCA - some people and places. Generally folks like the music anyway. I get a lot of emails from folks entirely unrelated to the SCA that love the songs and want to know the stories behind them.

There's some traditional stuff there, as well.


Nitefox - I'm still waiting for you to cease using my copyrighted material without permission. The more I read up on Fair Use, the more I think your usage of that image does not qualify.

And for the record, I thought the avatar swap was pretty funny. I giggled alot.
But I see the Monte/Nitefox mortal enemy thing with humor most of the time...its the only way I can stay out of it, and it reminds me of a couple of little kids which is cute.

ROFL! My son and I just watched Robin Hood: Men In Tights yesterday. Funny movie if you haven't seen it, but I bet you have since you pretty much just described it. :D

Nope, modern dress. We met in that tavern - me playing music and her working behind the bar. Her family and their close friends run the place. It's basically awesome. It's survived Hurricane Katrina with na'er but a 3 inch shift in a single beam. It was also constructed using a period design (in so far as building code would allow).

You believe it to be protected material, but based on what grounds?

Entertainers, politicians, and others who put themselves into a public spotlight have a reduced expectation of privacy for their image. Period. That's the law.

Let's assume it is protected though; one of the grounds for winning any dispute would be an assessment of what you've done to protect that copyright. Have you posted notices online and in all other areas where that copyright appears? Did you register a trademark? Failure to protect material indicates you don't hold that material as valuable. Hence, xerox can be used lower-case and without permission, as can kleenex, even though both are registered brand-name trademarks: they failed to protect their material.

He's talking specifically about copyright law. And while I may or may not agree with Nitefox's use of the image, I disagree with Monty's perception that it is protected material.
