Well, one of the issues is that the constitution is in conflict with itself. One of the original provisions of the constitution is "to promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries." Regardless that current copyright law goes far beyond that intent, if copyright does infringe on free speech, then the first ammendent is in conflict with the copyright clause. However, ammendments being what they are, they tend to supercede that which went before them. It's not exactly a simple issue. |

I'm not even commenting on the substance of the arguments. I only read the blurb I found on their website, so far. In which the book is described as proposing that copyright is not necessary to encourage intellectual property creation. Thus, if the book is, itself, copyrighted, then the authors are a bunch of hypocrites that I have no need to pay attention to, because they don't buy the **** they're writing. |

I have a similar reaction whenever William Gibson goes on a spiel about how great "remixing", etc. is. I wonder how great he would find it if someone remixed some of his copyrighted novels. |
