A muslim Judge throws the case out and lectures the assaulted for insensitivity. Glad I don't live there. Maybe we should find a lame excuse to invade them and spread freedom everywhere. I'm sure that in time we will win their hearts and minds or some sappy ****. |

Can you appeal a judge dismissing a case? Wouldn't that be double jeopardy or something? |

I don't think it's double jeopardy unless you have a full trial and acquittal. That said, I don't think citizens bring assault charges - the state does. So I don't think he can appeal. Assuming this is in the US. |

Yeah, the State brings assault charges, but they should be able to appeal the dismissal, shouldn't they? Especially in a case as blatant as this. As for assuming it's in the US -- the second video indicates it occurred in Mechanicsburg, PA. |
