I see... I didn't realise that the congressional body and president were static and uniform...

I don't see that this makes any difference. Exactly what makes you think that any change in either branch would cause them to recognize unConstitutional law and do anything about it, or avoid simply putting in place different laws that are more to their political preference?

The executive has been enforcing as it sees fit, and the legislative funding as it will for the entirety of our history. This is an odd example of you being accidentally right for all the wrong reasons.

No, they haven't been inane.

You made the argument that 200+ years of precedent should be used as the final arbiter in the argument about which branch(es) of government has the authority to disallow government action or legislation that they find to be unConstitutional; and based on that argument you concluded that to be the province of the courts. I've pointed out that you're wrong, because we have 200+ years of precedent demonstrating that both the executive and legislative branches hold the authority to disregard court decisions they find in error by withholding enforcement and funding.

A) non-sequiter. Whether the other branches actually comply with court decisions does not have anything to do with whether the court legally possesses the power to make the decisions. You are conflating legal precedent with historical practices.

B). The general practice of Congress and the President has been to regard USSC decisions as binding. Exceptions exist, but the actual prectice of Congress and the President has been acceptance of these decsions.
