So apparently the NAACP is going to go after every "Stand Your Ground" law in every state. All because Zimmerman was acquitted in a case that had nothing to do with Stand Your Ground.

That's what democratic lobby groups do, use emotional circumstances to try to push laws.

Hopefully they won't succeed, but we'll see.

I just remember that with OJ we had heard that a verdict had been reached early evening, but there wasn't a reading until court was in session the next day. There was plenty of time for everyone to make arrangements to be in front of their TV sets for the reading. By contrast, this verdict seems snuck in. Saturday night, while most people otherwise occupied.

How is it any different from the cops who got convicted on civil rights charges after they were acquitted for the Rodney King beating?

If I were Zim, it'd be time to move to Switzerland or something.

I was surprised by the verdict, so I'm not going to speculate as to what the Feds are gonna do. Charges weren't filed in the first place until the Obama administration got involved, though, so we'll see.

That's totally irrelevant, at least to the question of whether it's double jeopardy or not. That's a constitutional protection and it doesn't apply differently to people who work for the government and those who don't.

Under color of authority is not a constitutional protection; it s for civil rights violations commited by officials. However, civil rights violations are not the same offense as murder or manslaughter, so double jeopardy does not apply. However, the civil rights investigation was done over a year ago, so there might be a case for malicious prosecution, based on the fact that their filing would be obvious retaliation for the not guilty verdict.

That doesn't really make sense. I could just as easily say that the civil rights conviction of the police officers in the Rodney King case was double jeopardy, because it required them to be guilty of the battery they were acquitted of.

It was Double Jeopardy, and it's a very real risk of how our Courts are currently bifurcated. It's also why Wrongful Death suits should be illegal.

Currently jurisprudence allows us to litigate the same circumstances 4 or 5 ways, and to keep doing so until we get the outcome we want.

I don't know of any statute regarding civil rights that requires a conviction for another crime before a proceeding under the civil rights statute can be undertaken.

Assuming that's true, however, it still does not make the civil rights proceeding double jeopardy; it just makes it impossible. The second murder trial (which would have to be a state trial) would be the double jeopardy.
