Kagan to be Supreme Court nominee, CNN confirms


[Update 11:06 p.m. ET] President Obama will select Solicitor General Elena Kagan as the Supreme Court nominee to replace the retiring John Paul Stevens, a legal source close to the process told CNN Sunday evening.

The nomination is expected to be announced Monday at 11 a.m. ET, another source familiar with the process said.

Kagan, 50, a New York native, was widely reported to be the frontrunner for the nomination. She was a finalist for the high court vacancy last year when Justice Sonia Sotomayor was selected to replace the retiring David Souter.

Kagan would be the third woman on the nine-justice bench if confirmed.

CNN is working to confirm the report.

Kagan is a former Harvard Law School dean and has never served as judge. As solicitor general, she is the Obama administration's top lawyer before the Supreme Court and has argued several high-profile cases before the justices since taking the job in spring 2009.

Kagan was a law clerk for Justice Thurgood Marshall and served as associate White House counsel in President Clinton's administration.

I don't know anything about her background, leanings (though I can make assumptions based upon who nominated her), but at the surface, I don't have an objection to nominating someone that hasn't been a judge, provided they are practicing attorneys with ample experience in the courtroom, in particular in that particular court (ie Family, Federal, USSC, etc) so that they are at the very least familiar with the rules of court, evidence, etc.

Picking a tax attorney to the position would not qualify.

Iirc, I disagree with her on the role of government and child nutrition (as thus came up during the nomination to her current seat).

If you're asking if it were up to me, at least 10 years and honestly I would prefer more. I'd prefer to have somebody who has experience thinking Constitutionally and who has had some of their decisions upheld/overturned by a higher court.

Yeah, for me, it's not the "lack of experience" as a judge that's the problem. It's the lack of a record of jurisprudence to evaluate.

I don't have any feelings that would make me disqualify someone who has never been a judge but without a record of rulings on cases and the opinions on why they ruled a way (which reveal an extreme amount about how a nominee views the role of law and government) I am extremely leery.

As has been stated, there's no requirement to have been a judge. I believe most were not prior to recently.

In fact, I think I like the idea of having a mixture of viewpoints and backgrounds among the nine.

Well, obviously not too much of a mix. As awesome as engineers are, none for the Court pls, thanks.

Kagan is Solicitor General and has been since Obama assumed office, basically. We have plenty of data that indicates she's unsuitable for the Supreme Court: her ridiculous arguments.

Kagan drafted the "Collective Right" argument in Heller vs. DC as a special solicitor appointed by the President. She literally told the Supreme Court that the present of the National Guard satisfied the Second Amendment for all Citizens and that the Federal government could ban private ownership of firearms.
