Not all salaried employees are exempt, which is why the 2004 revision to the FLSA that you posted is so significant. It codifies and reinforces the difference between salaried and exempt. Of course the duties "required" to be exempt are so vague and elastic that you can easily reclassify most salaried positions to exempt status to avoid the overtime concerns all together.
We went through the 2004 Revision here at the university. All non-Exempt employees became hourly at the recommendation of both the State and Federal Department of Labor. Indeed, unless they were contract employees (Professors), we were told by government officials they could not non-Exempt Salaried.
