If the city has a blanket "No soliciting without a license" law, it should apply to the water vendors as well. If it does not then the water vendors shouldn't be discriminated against.

As for the water vendors...get a permit and stop complaining! Didn't cost me anything for a permit to sell my handcrafted items a few years ago...but you do have to claim the sales on your tax return...at least here in California. Is that maybe what they are trying to avoid?
