It's interestingly problematic if your proof that the police are not biased against black people is data on how much the police arrest and charge black people. Some circularity....

Cause or effect?

Aside from the fact that I didn't say that, I don't need to prove a negative. Someone would need to prove that police ARE biased against black people, and they could not use the rates of arrest as that proof.

That would be the circular argument you are looking for, and it is the one most commonly deployed in public.

A non-circular argument would be that black people are more likely to be socioeconomically and educationally disadvantaged, which leads to higher crime rates within that population, and thus higher arrests.

Even then, more likely =/= biased. Correlation is not causality.

Hmm. I'll have to look at this more closely. Bias in that they are more likely to have a negative interaction with the police, but equal treatment in shootings with whites in similar situations. If bias leads to more interaction, then by extension, there would be more cases of those similar circumstances.
