NEW YORK -- A right-wing New Jersey blogger has been sentenced to 33 months for making death threats against three federal judges in Illinois.

Hal Turner was sentenced Tuesday in Brooklyn federal court.

The case stemmed from the 7th U.S. Circuit Court of Appeals ruling in 2009 by three judges that upheld a district court decision dismissing lawsuits that challenged handgun bans in Chicago and Oak Park, Ill.

Turner protested the decision with inflammatory remarks posted on the Internet. Prosecutors said he crossed the line by declaring, "These judges must die."

Turner had claimed his tirades were protected by the constitutional right to free speech.


The case was moved to Brooklyn based on a change-of-venue ruling. Two previous trials ended with hung juries.

Had to run the case 3x till they got a conviction? Guess jury nullification wasn't explained to the jurors.

I'd say there were points proved, but yours ain't one of them unless by "proved" you mean "this will get you thrown in jail".

You know what's really classy? Turner was an FBI informant against white supremacists. I wonder if they're going to sentence him to general population...

Hopefully his appeals go well. Retrying after a hung jury or two is perfectly legal.

I think it's pretty clear that anonymous death threats won't fly past a judge. I don't think an appeal looks too promising.

Just because people WANT the 'net to be lawless doesn't mean it's gunna be.

Merely wanting, perhaps not. But the internet will always remain lawless for those who can back it up with the right knowledge and capability.

Yeah, this wasn't just some "Mr. Internet Tough Guy", he had hosted radio talk shows, was a white supremacist, an FBI snitch and had previously assaulted the Jersey City Deputy Mayor. He also posted the names and addresses of officials when he called for their deaths, as well as the photos of the judges, a photo of the courthouse and a map showing its location. This was no anonymous post on a message board.

That said, it took three trials (with two mistrials) to convict him. It'll go to appeal.
