They've successfully bullied other countries into paying their ransom demands. They're hoping they can threaten and kill enough people that the United States follows suit.

Well we now have a number of prisoners taken from the boat, we could make an example or bring them to the US for a civilian trial.

A better punishment is sending them back to that craphole nation. Its a crap situation. If we start killing pirates, what incentive do they have to not kill any americans they find?

They weren't under the jurisdiction of the U.S. so a civilian trial does not apply.

So taking hostages and killing them, and piracy is not a crime? As it is not in any national waters, its a free thing? Fine so us torturing them to death would be legal as way.

That's how it works. If you fly a flag with Mohammed's face on it, and Persian forces capture you in international waters, should they rightfully try you for blasphemy and execute you? The answer is they shouldn't because they have no jurisdiction.

I believe there isn't any that has concrete authority. If they are brought to trial they could win.

If captured in international waters, I think whatever country holds the pirates would have jurisdiction. Diplomacy would likely (at least amongst most 1st and 2nd world nations) result in the pirates being extradited to country that makes sense given the situation.

My fear is that pirates wouldn't hesitate to kill Americans (if they knew they would be caught), in order to get a chance at a cushy life in an American prison.

I don't think it works that way... if it doesn't occur in a country's territory then they have no jurisdiction.

Lonedar has the right of it. According to UNCLOS Part VII Article 105, in international waters, every State has the right to seize pirate ships/apprehend pirates. The captured pirates are subject to the law of the country that captured them.

You make a good point about the secondary aims of the pirates, Lonedar.

It would take the US Marines all of a week to clear the entire Somali coast. Negotiate with a body count. Don't make the penalty for piracy pretty, either. Boil them to death or something. Or boil off their legs and dump them crippled into the villages they came from. They can serve the rest of their short lives as a warning not to board ships flying an American flag.

OMFG! Who wrote that news item, a 2 year old???

Also, speculation was this sentence was the reason for the kidnapping and subsequent murders of those 4 Americans.

I suspect strongly that the article was written by someone who is not a native english speaker. That particular link was just the first one that came up on a google search. I didn't vet it at all (wasn't necessary). It turns out that the articles there are user contributed.
