At least for one woman in Brazil it is legally protected.

http://m24digital.com/en/2011/05/11/the ... e-at-work/

Quote:
The woman suffers from a rare condition known as “compulsion orgasmic”, caused by a chemical alteration in the brain region of the cortex, which leads her to masturbate several times a day to relieve the deep anguish that it causes.

Under this circumstance, Bezerra started legal proceedings with the company where she works that eventually won and that enables to masturbate for 15 minutes every two hours, besides using the computer to see erotic images that stimulate her desire

I have to go look this up, and see if I qualify!

Here too, that is a reasonable accommodation for a legitimate disability. So unless a company could prove it would be an undue burden on them you're golden with a doctor's note.

You'd think a magazine and the ladies room would suffice.

Who needs a full 15 minutes? Less than 5.

This is bizarre. Masturbating at work? Aren't there other laws that would supersede the ones that won her this *right?*
Like what about the rights of others she works with? Having someone at work masturbating every two hours for 15 minutes could really disturb some people and make for a very uncomfortable work environment.

I'm hoping privacy is part of the deal, but in the end the comfort of other people does NOT supersede her right to reasonable accommodation for a genuine disability at work. In her case it's not really an option to not masturbate... would you be willing to pay her an equivalent salary to stay home?

And 15 minutes every 2 hours sounds like a regular break schedule... or the pumping schedule of a nursing mother. Women have won THAT right, no matter how uncomfortable people were.

So does she get an additional cigarete break afterwards?

I'm not sure it's a "genuine disability". I'm pretty sure it would be an asset in the porn business.

1. Doubting seriously that this is real (both the condition and the article).

2. 15 minutes every two hours means that she's useless for 1/8th of the workday.

3. I hope for her sake Brazil doesn't have "at-will" employment. I know if I were the owner/manager, it would be a mess of potential problems with which I'd certainly not want to deal. Easiest thing is to find someone else for that job. Sucks for her, but there you go.

1) The condition is real. I've seen it more than once in the news. Seems to always be females, though.

2) Smokers, in my experience, are useless for equal amounts of time.

3) If Brazil had at-will employment, this case never even would have gone to court. California is an at-will state and I can be fired (or quit) for any reason, any time.
