You're right, it does.

You're assumed innocent until proven guilty in a court of law.

That bold part is important, and frankly I want our news industry supporting it. They **** up enough court cases with predjudice as it is.


There is innocent until proven guilty, and then there is "a restaurant full of people watching a 16 year old hold a gun and demand money from a Mcdonald's employee"

There isn't going to be a trial for the dead criminal, so there will never be a chance to call him guilty. I don't think the news media would be doing anything wrong by headlining "Armed robber shot..." instead of "Teen robbery suspect..."

IMHO, calling him a robbery suspect is political correctness gone haywire.

To follow: When googling this story, I am finding headlines calling him a "suspect" along with many that simply call him "robber"

They open themselves up to libel if they just say armed robber. Just because everyone knows he/she is guilty you can't say it unless he/she is convicted.

What about in a case (such as this one) where there will be no trial for the dead criminal?

Who gets to call him guilty? Or is there some legal "process" where he is proven guilty?

I'm thinking of all the cases were there is a significant amount of media coverage, which makes the whole jury selection and trial process significantly more difficult than it already is. I'd be curious to see numbers on it as well.

I suspect your suspicions are unsupported. There are very, very few cases in this country where media coverage plays any role in jury selection or administration.

Perhaps one or two a decade that are just too huge (Simpson, Anthony), but that's a drop in the bucket. Honestly though if you study both of those cases I think the powers that be tried very hard to make sure all the attention didn't color their proceedings.

Khross claimed that there were very very few where it plays any role. I 'm not suggesting that mistrials result--I suspect the number of mistrials due to media coverage is very very small as Khross states, but we dont hear about the people dismissed in voir dire because the system is working 'as intended' but it still plays a role.

This is basically what I'm getting at. I have to imagine that the jury selection process is much more costly and difficult based on media coverage. Similarly, I've certainly heard a lot of lawyers comment that their client can't get a fair trial because of bias, etc. Now of course some of that is just good lawyer speak, but I'm sure there is some amount of it happening as well.

I'm also sure it's almost impossible to quantify.
