 Post subject: not doing so well

someone turned left in front of me Sunday morning. I'm not too bad off, car is probably done for. I can't take time off to deal b/c too many people are on vacation. long day tonight with that workload and trying to deal with insurance. tomorrow is not looking much better.

the strangest thing is I couldn't find my glasses after getting hit so I went to the hospital without them. I had dad get my spares. I found them when I was able to get back in my car today. They had ended up in the the top vent of my dash (the grill is off) prefectly folded up without a scratch on them. which is really strange considering the way my forehead and left eye are bruised, unless they went flying first. I really expected to find them cracked or mangled. It almost has a touch of the divine. I can't imagine a mortal somebody finding them and putting them there when there were plenty of other spaces available where i might think to look, especially when nothing else in the car seemed to have been touched.

Take it easy, as you can and take care of yourself. Let them know you are toughing it out because you are that kind of responsible, but that you are taking the time to deal with it as soon as folks get back.

So anyway turns out I have to go to court next Friday (next week not tomorrow). Guy that hit me is a juvinile so that means mandatory appear and I guess he decided to go with not guilty. I'm being called as a witness. On one hand its kinda cool since I've never done it before. On the other hand, I'm worried/nervous that someone is going to try to push it on me. I mean his insurance has already paid for my car so what is to contend.

Whether he's guilty of the traffic violation. The insurance paying you wraps up the civil liability, if you're satisfied, which it sounds like you are.

The juvenile is accused of making an improper left turn (I don't recall the exact statute anymore), which is a "criminal" matter. Although traffic violations other than felony DUI are not actually considered criminal offenses in Ohio, they are handled through the same process as criminals. The state will have to prove beyond a reasonable doubt that he violated the law in question. The officer will no doubt appear too, and testify as to what he saw when he took the accident report.

Normally, in Ohio and most other States, a police officer may not cite a person for a traffic violation they did not actually witness. In the case of an accident though, the officer may testify as to the violation based on the accident that resulted, since he did witness the damage and injuries. This is also why more serious accidents involve officers specially trained in accident investigation and reconstruction; if the civil portion of the case is still contested, the result of the traffic trial may bear on it, and so the officer's investigation should be as scientific and abstract as possible.

I always liked taking accident reports, because the facts truely spoke for themselves. People got to make written statements, but most of the time all you had to do was look at the damage on the cars and where they were on the road, and you knew exactly what happened.

Since you probably don't have a lawyer to tell you about it, being you're just being called as a witness, I might make one serious suggestion: Make no assumptions or suppositions, and don't be afraid to say "I don't know" or "I don't remember." Since the civil matter appears to be settled, there's not much damage you can do to your own cause by being a witness, but you can only make your day longer by trying to fill the holes in your memory.
