Maryland State Police officials have charged 40-year-old Joseph Walker with second-degree murder and manslaughter in connection with the shooting, which killed Joseph Harvey, Jr., a 36-year-old Halethorpe resident.

Walker, an Eastampton Township, N.J. resident, is being held at an Anne Arundel County jail on $1 million bond. He is an officer with the Hudson County Prosecutor's Office in New Jersey.

The shooting happened at about 8:30 p.m. Saturday on I-97 near the Route 3 interchange near Millersville. The incident began, though, when police say Walker cut Harvey off while trying to turn onto Route 3.

Harvey then drove onto the shoulder to try and avoid a collision, then nearly hit Walker's car while continuing to drive on the side of the road, according to a police report.

Authorities say that the two drivers then tried to intentionally swerve into each other, at which point Harvey's passenger told police that Walker pulled out a gun and pointed it at them.

A short time later, both Walker and Harvey pulled over and both got out of their cars. Walker got out of his minivan and yelled that he was a police officer. At that point, police say Harvey approached the suspect in what they call an "aggressive manner."

That's when officials say Walker pulled out a gun and shot Harvey in the leg. His passenger was not injured. Harvey was taken to the Baltimore Washington Medical Center, where he later died.

After the shooting, Walker was taken to the same hospital complaining of chest pains.

Anyway, Harvey was a friend of mine. Genuine nice guy.

You know, if you're going to be involved in a road rage incident, and pull your car over, get ready to brawl. There may just be words. But if you're worried about your safety, don't pull the car over.

Knowing Harvey, I am highly dubious that there was any physical aggression by him.

It says he's an "officer with the prosecutors' office." I'm not exactly sure what that is, but unless NJ has some really weird setup, he was probably misrepresenting himself as a cop (on top of everything else.)

Fortunately, we came to an exit after a few minutes of this nonsense, and I was able to cut over and exit after he was already passed the ramp. Anyway, the point is, I can definitely see how your friend's decision to pull over might have been a defensive move rather than an aggressive one. Even getting out of his car could be construed as defensive, since it would be hard to defend yourself from a seated and seat-belted position if the guy approaching you decides to attack, although in that case, it would probably be better to wait in your car until he gets out of his and then just speed away.

Stay in your car, call 911, draw your weapon, warn the other person to stay back.

At least, in Ohio, that's how I'd do it.

My statement was directed at the shooter. I do feel it's somewhat harder to justify shooting someone in self defense if you pull your car over to confront them.

I've pulled over before to confront rude people. I was prepared for a tussle, but preferred words. Simply getting in a tussle is not cause for a shooting IMO. Kick the guy's ***, or get yours kicked. No need to bring weapons into it in that situation.

However, on rare occasions, I do feel the need to explain proper manners.

And no - this does not extend to idiots and people who make mistakes. I am quite patient with such people.

This is hardly a recommendation. I'm simply saying that merely getting in a tussle is not cause for weapons. Rynar's example above does not apply, as he would not feel the need to defend himself. You don't attack people that are not willing to fight. All Rynar would get is words. If he shoots me for words, he'll go to jail.

If I've just been in an accident, and some aggressive ******* comes towards my car, appearing outraged, I'm taking out my hand gun, and telling him to get the **** away from me and my car.

If he doesn't and appears intent to want to "tussle" with me, I'll fire, center mass. No one has the right to assault anyone else, but everyone has the right to defend themselves from assault.

But hey, if you feel like your torso isn't ventilated enough, feel free to act like an idiot.
