I might, on grounds of disagreeing with the premise of allowing the league to both ban him and fine him. They should be able to do one or the other, not both. He should sell the team and refuse to pay the fine, and make them spend the legal fees to get it.

Why? The Government can both fine and assign jail time.

Its in the NBA bylaws that they can do both. Sterling agreed to them.

While it's true that "freedom of speech", as a legal/Constitutional matter, is only infringed when the government interferes with said speech, I think a broad cultural norm in favor of an open discourse that makes room for disagreement without punitive response is also extremely important. The threat of losing one's job and being socially and economically ostracized can be every bit as restrictive in practice as government censorship, so if we're to claim any real commitment to meaningful freedom of expression, we should be very, very hesitant to materially ding people for saying **** we don't like. An octagenarian saying something mundanely racist in private doesn't come close to qualifying, in my opinion.

That's what I was trying to get at, thank you.

I think you should be fired for the racist/sexist jokes you have made to friends and family (not to mention on this board).

You have just made the single most ironic post in the history of the Glade.

If I owned a kosher deli, my customers would expect me to not say things like, "You know, I think Adolf had it right. It's a shame he couldn't finish his project." If word got out that I ran around espousing that opinion, I'd lose most of my customer base and probably have to close my deli. I'd get some new customers, but not enough to replace the pissed off kykes who boycott me.

A lot of the NBA's customers are black. The vast majority of players are black. The writing on the wall is that nobody is going to watch Clippers games. That negatively impacts whatever team they happen to be playing on a given night. The League has language written into it's charter to allow them to deal with situations like that, and they are making use of it. If you listen to Sterling talk, he knew he didn't want this getting out. He knew what he had signed, what was in the contract. Sterling didn't have the Clippers taken away, he was forced to sell them. There is a difference. He's getting money for them. Not as much as he would like, but the Clippers aren't as valuable now after he ran off at the mouth. I didn't get a dime for closing my deli.

When you are a CEO or the owner of a major business enterprise, you know that while you have the freedom of speech, you don't want to say things that will kill your company. Notice that you never hear top Monsanto executives saying they think all the liberal hippies should be thrown into a wood chipper. Monsanto gets enough flak as it is, and the company doesn't need one of its executives advocating actually running over tree hugging activists with a bulldozer.

1. I don't work for the NBA. I'm not in a position where this would be that big a deal. My Coworkers know I'm not like that, and they're just jokes on a message board.

2. Noone cares who I am enough to "out" me to TMZ.

3. I don't really have a 3, so I'll just say eat a dick.

So it's ok to be a sexist, racist douchebag so long as you're nobody?

(edit: Not that I think you are a racist, sexist douchebag. We all make jokes and I personally think that is ok.)

Define "OK."

Its perfectly legal to be a sexist, racist douchbag, whether or not you're nobody. The difference is in other consequences. Being known as a racist is a reputation issue. For the average person, nobody knows who they are, so they can be racist and most people don't ever know about it. For someone who's in the limelight for some reason (money, occupation, or some other source of renown), then you better be damn careful what you say, yes.

What Taly said.

Be whatever you want, as long as you're ok with the consequences. Sterling signed a thing that said he would not engage in "Conduct detrimental to the NBA". I would say his conduct was definitely that, seeing as how the Clips were hemorrhaging sponsors because of said conduct. The NBA was well within their rights to say "Time to go Dinosaur!" and drop a comet on his bigoted ***.

If he's racist, you can't tell from his hiring practice. Stirling was stupid in private. That privacy was illegally violated.

I'm not in favor of this having the traction it has. The NBA shouldn't have weighed in at all.

The privacy thing doesn't matter. He's not being prosecuted by the government. Its inadmissible in court, but once out to the wild, he said those things, he holds those views. He damaged the NBA by being a bigoted *******.

He could easily have not been removed from the NBA by not being a bigoted *******. That's all it would have taken.

Except that once they kick him out, he's not subject to the by-laws. Also, they aren't the government. "But gummint!" isn't an effective argument.

The discovery was due to an illegal act and shouldn't have been made public, just as sure as if his home had been broken into and his dirty laundry put on display.

Everybody has dirty laundry, and privacy laws - not just those rules for the government, but rules for everyone - are in place for things just like this.

Meh. I find it hard to defend a bigoted ******* that still thinks its OK to own slaves. He likely has legal recourse against the gold digger, but once the tape was released, the NBA had no choice but to act.

If his house was broken into, I'm sure there'd be nothing but white sheets and whatnot. He doesn't seem a fan of coloreds.

It's not so much defending him as it is defending the right to privacy which happens to be touching him, filthy as he may be.

Owning a sports team is like joining a homeowner's association. If you don't like the fact that they get to control what you can do with your property, spend your money elsewhere.

What was done is either wrong, or it exemplifies "the ends justify the means". That only works out when one agrees with the "ends", otherwise, not so much.

50 years ago, your opinion would have earned you the kind of public derision this guy is getting now... that wouldn't have worked out so well for you. Like I said, the guy was stupid, but he was stupid in private and that's where it should have stayed.
