Quote:
U.S. District Judge Ricardo Urbina said Justice Department prosecutors improperly built their case on sworn statements that had been given under a promise of immunity. Urbina said the government's explanations were "contradictory, unbelievable and lacking in credibility."

Quote:
Urbina's ruling does not say whether the shooting was proper, only that the government improperly used evidence to build the case. After the shooting, the State Department ordered the guards to explain what happened.

Investigators promised the men that their statements were to be used only for the internal inquiry and would not be used in a criminal case. Such limited immunity deals are common in police departments so officers involved in shootings cannot hold up internal investigations by refusing to cooperate.

What they're talking about is not a "limited immunity deal", it's called Garrity rights. Essentially, you cannot compel a person to speak in an administrative proceeding or internal investigation and then use the information gained in a criminal trial. This is to prevent officials from using the ability to order a subordinate to answer questions for internal purposes to make an end run around their Fifth Ammendment rights.

So disappointing. By the way, this is not so much an exoneration of these killers as it is a rebuke of the prosecution.

Yes it's shame they couldn't be bothered to do things right the first time. You think after 200+ years they'd figure it out.

When the prosecution needs to rely on shady methods like this to build a case, it's a strong indicator that they couldn't do it in a legitimate fashion.

I applaud the judge for his decision. And the reason for his decision.

The thing that seems like such hilarious karma here is that it's the liberals trying to paint all kinds of **** all over Bush that pushed for those investigations in the first place -- you know, the ones that ended up protecting them from criminal charges. The demand was so strong to know exactly what happened, and know it yesterday, that nobody bothered to care about setting up a criminal case in the event of wrongdoing.
