What is interesting here is that the TAG boat (the one closest to the camera) had the right of way. Both vessels appear to be on a starboard tack (wind coming over the right side of the boat). In that case the downwind boat, which is the TAG boat has the right of way. The Oracle boat should have gotten out of the way. It is difficult to see for sure what tack the Oracle boat is on, but if it was on a port tack, then is was doubly wrong. Starboard tack has right of way over port.

Since these are racing boats there was probably a race under way. The Oracle boat should have been penalized or disqualified for that.

The near side of the Oracle boat is lifted higher. I'm pretty sure it's on a port tack.

Actually, the "TAG boat' and "Oracle boat" are the same. The other boat was the Emirates team, which also has Omega logos.
And it appears the Emirates team *was* penalized.
