Or a Browns fan ;p

If the Browns had the Seahawks on their schedule this year I'd wager a case of Great Lakes Xmas Ale against some... rain? What else is Seattle known for?

That was true up until the last 4 games of the season when they suddenly remembered how to play football.

I'd say this was more due to the removal of the last of the negative elements in the locker room (Jamal "8-Ball" Lewis).

That's what I call remembering how to play football.

Well, I read some of what was argued, but I'm not exactly sure what James Feldman was wanting, exactly. Sounds like he wants "guns are bad" weighed when determing the sweep of gun rights.

Yeah... his argument was essentially that the 2nd shouldn't be applied because guns are different...

That's true, though. The founding fathers would never have passed the 2nd amendment if they knew that we would invent guns someday.

So: 1. Guns are dangerous.
2. MR. FELDMAN: I mean, if by that is, do you have a substantive right to self-defense, the Court actually has never answered that question, but I am willing to accept that there is such a right.

This Feldman guy isn't doin so well.

Bottom of page 40.

Feldman gets Pwnt.

Quote:
JUSTICE BREYER: Step one -- step one is, make my chart. Step two is, look at what's high. Step three is, even that that high part, even that high part, nobody could think was incorporated.
MR. FELDMAN: I -- in our view, the things that the framers -- the framers had their reasons for putting -
JUSTICE BREYER: That's how you think Madison went about his job?
MR. FELDMAN: No. No, I think that -
CHIEF JUSTICE ROBERTS: He did, actually. He did. That's how he went about it
JUSTICE BREYER: I'm asking Counsel. Do you think that's how Madison went about his job?
MR. FELDMAN: I think the framers had reasons to put everything in the Constitution that they put in it. But the question about whether it should be incorporated against the States is a different question than whether they put it in the Constitution. And what you have in the Second Amendment, and it's right clear on the face of it from the prologue; it's clear -- it's clear from the opinion in Heller, is the reason they put it in the Constitution is not the primary reason why people today are arguing that this is a right that is so fundamental that -- that it has to be applied against the States.

Quote:
JUSTICE SCALIA: Is that what you are asserting here, that the States have to allow firearms?
MR. FELDMAN: No.
JUSTICE SCALIA: Is that -
MR. FELDMAN: I -- I didn't think I was.
JUSTICE SCALIA: I didn't think so, either, so why did your last argument make any sense?

Interesting to read. Feldman did a bad job, IMO.

He did a great job, just for the other party in the suit.

That's very true. I didn't want to get into that though. It was pretty funny, really, how well he established for the other side their case.

Arguments summaarized:
GURA: Scalia! An argument for incorporating under privileges and immunities, YOU CAN HAS!
SCALIA: WTF are you talking about? We can incorporate it under due process. I hate due process and I even think that.
GURA: Uhhh
SCALIA: Are you trying to get a job at a law school?
GURA: Oh ****
SCALIA: SERIOUSLY STFU IF WE USE PRIVILEGES AND IMMUNITIES THESE F*CKOS WILL LEGITIMIZE EVERYTHING STFU STFU STFU
GURA: But you hate due process
SCALIA: I LIKE IT NOW
GURA: Uhhh
GINSBURG: I’m a b*tch!
SCALIA: LULZ
STEVENS: I’m a b*tch!
CLEMENT: This should obviously be incorporated under due process.
ALITO: Werd
BREYER: *motorboats Sotomayor*
FELDMAN: Here’s my first argument.
SCALIA: That argument sucks.
FELDMAN: Ordered liberty?
SCALIA: We haven’t used that since 1937.
FELDMAN: Have too.
SCALIA: When?
FELDMAN: Uh, here’s my second argument.
SCALIA: You just argued against your first argument.
FELDMAN: Did not.
SCALIA: Did so.
FELDMAN: DID NOT!
SCALIA: …
FELDMAN: *cries*
SCALIA: …
ROBERTS: You just argued the losing Heller argument.
FELDMAN: *pees pants*
BREYER: Let’s make a chart.
ROBERTS: Madison made a chart!
BREYER: STFU
THOMAS: *reads the Bible*
SCALIA: The 2A puts the fun in fundamental.
FELDMAN: Let me tell you what Heller says.
SCALIA: I wrote Heller, f*cknuts.
KENNEDY: So if we’re going to just incorporate the militia purpose of Heller, what case do we use for precedent?
FELDMAN: No f*cking idea.
SCALIA: Why are you talking about the right to self-defense? That’s not in the Constitution.
FELDMAN: See above. Besides, nobody would really restrict the right to keep and bear arms so that it affected self-defense.
SCALIA: Have you even read Heller?
FELDMAN: I don’t think so.
KENNEDY: Gura, let’s use your last three minutes to talk about everything but the 2A.
ROBERTS: I’m going to give you the chance to take back that privileges and immunities thing.
GURA: No, we think it’s a good idea!
ROBERTS: *sigh*
