Because it wasn't nearly as obvious to the average Joe as it is with this "It's not a tax except that it counts as one as far as we need it to for it to be legal" road they've gone down.

Hes not, now that it has passed, and letting the DoJ use that argument is clearly and acceptance of the condition. At the time though, he had to defend the bill against those claiming he was breaking that promise out of the gate.
