It's not distilled, though. Distillation is separation by differential vaporization and subsequent condensation, not by differential freezing.

While this is true while speaking about polymorphism from a chemistry/physics standpoint, so-called "ice brewing" is referred to colloquially as "freeze distillation" or "fractional freezing" within the brewing/distillation trade. When spirits are defined as "distilled" alcoholic beverages, "fractional freezing"/"freeze distillation" are considered to be among them, hence the somewhat idiomatic use of the word "distill" in this particular context.

I guess if the brewing/spirits guys wanted to be semantically consistent, they should redefine "spirits" as "polymorphic process alcohol enhanced beverages" or PPAEB. Maybe we can come up with a better acronym?
