That made me cry. What a horrible, despicable thing to do to someone! I don't care what he did to make her think that he "deserved it," no one deserves that. Even if my husband cheated on me with half the state and treated me like ****, (which he would NEVER do btw my husband rocks), I still wouldn't even consider poisoning him or maiming him like that....that's awful! Poor guy!

What makes you think the husband filed for the divorce, Midgen? The article says only that the couple is "going through a divorce".

I'm not sure of all the legality behind this, but...

It seems to me since there is implied consent in marriage, it would be an assault/battery issue, not really rape. There's a lot more to "rape" from a legal standpoint due to the danger and consequences of an unauthorized penetration. These are not at issue in a marriage, thus the focus should be on the battery and abuse.

That said, Bobbit never proved any of it.

Rape in marriage has to involve actual force or actual threat of force. Consent is implied; you must actively say "no" to your spouse.

And, as DE said, since consent is assumed there must be force (or the threat of force, or other coercion) involved. I remember hearing about a case some years back where the husband demanded sex or else he was going to file for divorce and take this children with him to his home country. I don't recall what the verdict on that one was. And I was speaking generally, not about this specific case, anyway. It would have to be extreme circumstances, but there are situations in which I would de-junk a man. I doubt this woman was in such a situation.

In then end (no pun intended) a married woman has the same right to refuse intercourse as an unmarried woman.
