That's pretty irrelevant, however. What's important is how other people perceive your actions, not your intent. And the perception is definitely that bringing a gun is threatening violence. Assault charges are not based on the victim's perception. A victim can claim to perceive anything they want.

Making your message clear is your responsibility, but the perception is not all that is important. People who read things into others' messages because of their own preconceived ideas (exactly what those accusing TP gun toters of violent intent are doing) are at fault, not that of the one carrying the gun.

Based on the YouTube videos of police letting loose with the pepper spray and making arrests at OWS, perhaps OWS could use a little implied threat of violence.

It's funny to me that the people complaining about the police state are the ones who AREN'T armed. I mean, that just strikes me as a "duh" moment.

Still, it's not that far fetched that one of these guys is a wacko.

It'd be interesting to know if there's any "incitement of hate" going on at these rallies by any of the speakers. How much of that did we hear about the tea party rallies?

They'll get bored. Americans aren't made of much nowadays.

Also, whoever runs the Tea Party needs to make sure people don't bring guns to a goddamned peaceful protest. Stupid shits. Things like that really piss me off. Well when a cop tells you to move 10 times, and you disregard him, things won't be too fun for you.

You don't have the right to loiter on public roads without a permit. It's that simple. It blocks traffic which is vital to a city.

Perception is exactly how assault charges work. If a "reasonable person" would interpret the conduct as threatening then it's assault. Your intent is irrelevant. That's also why its so easy to accuse people of stuff like sexual harassment, because if you believe you're being sexually harassed, you pretty much are.
