I actually did some research on the child pornography laws for a project while I was in college and pretty much ANYTHING that even remotely involves a childs image in something that could be perceived as sexual in nature even if it is 100% fictional (i.e. drawings, anime, etc) qualifies as child porn.

It's hard to know where to draw that line....on an individual basis it usually seems so clear, but for the sake of a lot of teenagers and smaller children, I'm really glad the laws on this and the consequences (hopefully) are ironclad.

I'd be careful there. That could fall along the lines of "she was asking for it" or something. Its nobody's business if a teen wants to walk around commando and it also doesn't mean its ok to take pictures of her privates even if she had an accident or something.

I'm actually of two minds here LK... on one hand, wearing a shortish skirt with no undies and getting out of a car = someone will see it, especially as you're a celebrity and have fore knowledge of this. On the other I believe photographers should have some decency to censor themselves when it comes to these things...

So in this instance knowing full well she gets photographed a lot, and having seen her predecessors (think britney, lindsey, paris, etc) it's kinda hard not to go with the "she's asking for it" line of thinking.

This is the part that gets me more than anything. I just committed a crime, but oh I'm underage, thus not legally responsible for my actions. There comes a point (pre-adult) where you have to take responsibility for your actions. A nine year old is one thing, but a 17 year old -- c'mon.

If you have your picture taken 1,000 times a day, you need to understand that commando + skirt + high stepping out of a convertible means this sort of thing is not only possible but highly probable.

A 17 year old girl is not as mature as one might think.
Regardless of how you look at it, she is still under 18.
Whether it was a genuine accident, an accident-on-purpose, or an outright and purposeful on her part flashing of herself, she is still underage and Perez Hilton broke the law.

It would appear that it was an accidental flashing. You guys make it sound like she was showing off her stuff on purpose.
We can speculate but I don't think we know for sure.
Some women like going commando and accidents happen...guys too. I can't tell you how many times I've seen some guys nads hanging out of his shorts when he hiked his leg up for a step or something and didn't realize he was flashing the world.
If we all had cameras following us around everywhere I'm sure we'd catch some embarrassing stuff too.
